Hear a quick overview on property coverage issues (pressure on replacement cost coverage to build back better and in a different location); pressures on liability coverage (expanding theories of liability for property damage induced by climate change, whether greenhouse gases are a pollutant, how D&O policies are confronting greenwashing claims and ESG reporting issues).

In this second of the two-part panel session, learn from current and former Appellate Court and former Trial Court perspectives what went right, what went wrong and what coverage counsel on all sides could do better in shepherding complex cases through the system. Judicial and court officer input will provide unique insights into the challenges of administering appeals in the Vale (jurisdiction) and Loblaw (coverage and handling) litgation, while experienced arbitrators formerly members of the bench in two different provincial court systems will provide their take on what makes for a successful run through the system including arbitration alternatives for complex coverage disputes.
