Reform of Privacy Regulation in Canada: Implications of Québec’s Bill 64

In September 2021, the Province of Québec enacted Bill 64 which pertains to the collection and use of personal private information (PPI). The standards set by this legislation, which come into effect over the next three years, are the closest emulation of Europe’s General Data Protection Regulation (GDPR) currently in existence in North America.

This legislation applies to the collection and use of the private, personal information of Québec residents anytime, anywhere. Enforced by the first Canadian privacy regulatory body with the power to impose administrative monetary sanctions for non-compliance with privacy laws, the monetary sanction for noncompliance is stiff. In addition, there is a private right of action for privacy violations.

Will the currently planned revamp of PIPEDA follow suit? Alberta, British Columbia and now Ontario, are having a close look at Bill 64. The result could be a national sea change in the regulation and enforcement of Canadian privacy rights.
