This CPD will look at the intersection of civil and criminal matters and the unique issues that arise in this context. Over the course of 90 minutes, the presentation will address the following:
- When will courts stay a civil action in light of a criminal investigation or prosecution;
- Obtaining criminal files: when, how and what can you get;
- Use of documents, transcripts and decisions from a criminal trial at a civil trial: is it allowed, what is the test; and,
- The deemed undertaking rule: what is it and how does it play out in this context.
Coverage issues: when is a claim excluded because of a criminal act
