Join us for an in-depth discussion on the legal complexities surrounding medical conditions and personal injury claims, through the case of Zapata v. Reid, 2025 ONSC 594.
On July 17, 2017, David Reid suffered a seizure while driving, leading to a tragic multi-vehicle collision. Despite a history of brain cancer and prior seizures, Mr. Reid had adhered to medical advice, including a regimen of anti-seizure medication along with a driver’s license suspension for a short period of time, raising key questions about his duty of care and the legal defence of “inevitable accident.”
This case explores critical themes in negligence law, including the evolving role of medical conditions in accident liability and the burden of proof. We will analyze the intersection of expert testimony, the standard of care for drivers with medical conditions, and the legacy of the “inevitable accident” defence as it is applied in modern legal practice in Canada, within the context of a summary judgment.
