Williams v. Richards: the Ontario Court of Appeal analyzes Social Host Liability post Childs
In November, the Ontario Court of Appeal released reasons in Williams v. Richards. This interesting case involves the issue of the duty of care of a social host. Following a tragic accident, the surviving relatives of an intoxicated driver sued a homeowner for personal injury and Family Law Act damages after the deceased driver engaged in heavy drinking with the defendant at the defendant’s home. The action was initially dismissed on a summary judgment motion. However, the Court of Appeal overturned the motion judge’s decision, stating that there was a triable issue. This decision is important for lawyers who are defending liquor liability claims or homeowner liability claims involving alcohol or drugs.
